Commissioner Dye Addresses RILA Transportation Executives
On Thursday, August 22nd, Commissioner Rebecca Dye addressed a meeting of the Retail Industry Leaders Association’s transportation and infrastructure committee. In the discussion, she covered a variety of issues with a focus on implementation of the International Maritime Organization’s 2020 low sulfur fuel requirement, and the FMC’s Fact-Finding Investigation No. 28 into the reasonableness of demurrage and detention rules practices. Commissioner Dye explained that, as fact finding officer, she would shortly be recommending that the FMC issue an interpretive rule clarifying its view that such rules (and associated charges) were primarily established to provide a financial incentive for shippers and their agents to pick-up cargo and return empty containers in a timely manner, and that the recommended interpretive rule would reflect that incentive principle.
